General

These Terms and any operating rules and policies posted on our website We ScanGrader, including the Privacy Policy for Web ScanGrader, constitute the entire legally binding agreement and understanding between Zanido Software and our users ("you" or "user"), governing your access to and use of our Service.

By registering with Web ScanGrader you hereby declare and warrant that:

  1. you have read, understand, have the legal capacity to, and hereby agree to be legally bound by and to comply with these Terms in full;
  2. you are 16 years of age or older (otherwise, you can use ScanGrader exclusively with the involvement of a parent or a legal guardian) regardless of the age ratings assigned on the platform where you download ScanGrader;
  3. according to the laws of your local jurisdiction, you are eligible to enter into this agreement and have no restriction to use ScanGrader;
  4. you comply with these Terms and all applicable laws and regulations. If you use the Service as a business representative, you further certify that you are eligible to legally bind the represented legal entity, grant Zanido Software all permissions and licenses under these Terms, and disclose information about that legal entity.

Scope of license

Web ScanGrader is available at address http://web.scangrader.com.

Subject to your compliance with these Terms, Zanido Software grants you a limited, temporary, personal, non-exclusive, non-sublicensable, revocable, non-transferable, worldwide license to use Web ScanGrader on device(s) you lawfully own or control in the manner provided for in these Terms for personal non-commercial or internal business purposes.

Under this license you may not:

  1. sell, lease, rent, license, sublicense or otherwise distribute Web ScanGrader;
  2. copy, decompile, disassemble, translate or reverse engineer Web ScanGrader software, in whole or in part;
  3. write or develop any derivative software, make an attempt to derive the source code of, modify, or create derivative works of Web ScanGrader software, and its updates;
  4. provide, disclose, divulge or make available to, or permit the use of Web ScanGrader by any third party without Zanido Software’s prior written consent;
  5. avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Web ScanGrader or any other third party (including another user) to protect Web ScanGrader.
  6. remove the ScanGrader logos from answer sheets or reports.

Any attempt to do so will be considered a violation of these Terms and the rights of Zanido Software. If you violate any of the above restrictions, your use of Web ScanGrader will be reviewed and terminated, and you may be subject to legal actions and be held responsible for damages.

Zanido Software may provide upgrades, modifications, updates, or additions to Web ScanGrader software during this license. The terms of this license shall be applied to any such upgrades, modifications, updates, or additions unless they are a subject to a separate license that would accompany them.

It is understood and agreed that Zanido Software is the owner of all rights, titles, and interests in and to the original and any copies of Web ScanGrader software and related information, improvements, modifications, enhancements, or derivatives to it and the ownership of all intellectual property rights pertaining to it, in whole or in part, shall be, vest with, and remain the exclusive property of Zanido Software.

As a licensee, you do not acquire any ownership rights to the Service software through downloading, installing, or using Web ScanGrader. Your license to use Web ScanGrader shall be automatically revoked if you violate these Terms. We reserve all rights not expressly granted in these Terms.

SMS specific Terms and Conditions

When you opt in to the service, we will send you a text message with the following text: .

You can cancel the SMS or MMS service at any time by texting “STOP” to {short code or phone number}. When you send the SMS message “STOP” to us, we reply with an SMS message that confirms that you have been unsubscribed. After this, you won’t receive SMS any additional messages from us. If you want to join again, sign up as you did the first time and we will start sending SMS and MMS messages to you again.

You can get more information at any time by texting “HELP” to +55 19 99911 8777. When you send the SMS message “HELP” to us, we respond with instructions on how to use our service and how to unsubscribe.

We are able to deliver messages to the following mobile phone carriers: Major carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, MetroPCS, US Cellular, Alltel, Boost Mobile, Nextel, and Virgin Mobile. Minor carriers: Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless). Carriers are not liable for delayed or undelivered messages. Message and data rates may apply for any messages that we send to you or you send to us. You will receive {message frequency} messages per {time period}. Contact your wireless provider for more information about your text plan or data plan. Warranty Disclaimer And Limitation Of Liability

We promise that Web ScanGrader will function as provided for in these Terms during your license period and disclaim all other warranties. However, we cannot exclude that the Service software may malfunction, in which case we will apply every effort to resume its correct operation.

Disclaimer of Warranties

The Service (and any associated content or software) are provided on an “as is” basis.

Zanido Software expressly disclaims all warranties or representations of any kind, express, implied or statutory, regarding the Zanido Software technology, service, and content, including, without limitation, any implied warranty of quality, accuracy, performance, availability, merchantability, quiet enjoyment, fitness for a particular purpose, title or non-infringement.

Without limiting the generality of the foregoing, Zanido Software makes no representation or warranty that the Service will meet your requirements, be error free or uninterrupted, that all errors will be corrected or that the Service are free from viruses or other harmful components which may harm or damage your phone, computer or notebook.

Limitation of liability

Under no legal theory, including, but not limited to negligence, shall Zanido Software or its successors, affiliates, contractors, employees, licensors, partners or agents, be liable to you for any indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, cost of cover, goodwill, use, data, or other intangible losses (even if Zanido Software had been advised of the possibility of such damages), arising from or relating to (i) this agreement; (ii) your use or the inability to use the Service, content, or user submissions; or (iii) any interaction with any third party through or in connection with the Service, including other users.

The preceding limitations of liability do not apply to the extent prohibited by law.

If any part of the warranty disclaimers or limitations of liability is found to be invalid or unenforceable for any reason or if we are otherwise found to be liable to you in any manner, then our aggregate liability under all claims for any consequential, special, punitive, or indirect damages of any sort, including, without limitation, (a) any damages for lost profits, or (b) any damages resulting from loss of use or loss of data, under such circumstances shall not exceed the total amount of payments made by you to Zanido Software within one year preceding the date of such claim. >
